2. Description of the Guide Referred to in Section 10 (SAHRC Guide)

The South African Human Rights Commission ("SAHRC") has compiled a guide in terms of Section 10 of PAIA to assist persons wishing to exercise their right of access to information. The guide contains:

  • The objects of PAIA
  • Particulars of the information officer of every public body
  • The manner and form of a request for access to a record held by a public body
  • The assistance available from the information officer of a public body in terms of PAIA
  • All remedies in law regarding acts, omissions, rights and duties, including how to lodge an internal appeal and a court application
  • The provisions of Section 51 requiring a private body to compile a manual, and how to obtain access to such manual

3. Records Available Without a Request (Section 51(1)(c))

The following records are automatically available for inspection, purchase or copying without a formal PAIA request:

  • This PAIA Manual
  • Company registration documents (CIPC)
  • ICASA ECNS licence documentation (summary)
  • Public marketing materials and service brochures
  • General terms and conditions of service
  • Privacy Policy and POPIA Notice

4. Records Available Only on Request (Section 51(1)(d))

The following categories of records are held by One Mobile Networks and may be requested in terms of PAIA. Access may be refused where a ground for refusal in Chapter 4 of PAIA applies (e.g. protection of privacy, commercial confidentiality, or third-party information):

  • Customer contracts and service agreements
  • Billing and payment records
  • Call detail records (CDRs) and traffic data
  • Employee records (subject to consent and lawful processing)
  • Supplier and vendor agreements
  • Technical and network documentation

6. Processing of Personal Information (POPIA Alignment)

One Mobile Networks processes personal information in accordance with the Protection of Personal Information Act, 2013 (Act 4 of 2013) ("POPIA"). We are committed to processing personal information lawfully, fairly and in a transparent manner. Our processing aligns with the eight conditions for lawful processing under POPIA:

  • Accountability
  • Processing limitation
  • Purpose specification
  • Further processing limitation
  • Information quality
  • Openness
  • Security safeguards
  • Data subject participation

Data subjects may exercise their rights under POPIA, including the right to access, correct, delete or object to processing of their personal information, by contacting the Information Officer.

7. Purpose of Processing

Personal information is processed for the following purposes:

  • Provision of telecoms services (VoIP, Hosted PBX, Wholesale Voice, SMS, Call Centre Solutions, Cloud Infrastructure)
  • Customer onboarding, billing and account management
  • Network operations, fraud prevention and security
  • Regulatory compliance (ICASA, RICA, ECTA)
  • Marketing and communications (where consent has been given)
  • Employment and human resources administration
  • Legal and contractual obligations

8. Categories of Data Subjects and Their Information

9. Recipients of Personal Information

Personal information may be disclosed to the following categories of recipients, where necessary for the purposes set out above:

  • ICASA and other regulatory authorities (where required by law)
  • Carriers and interconnect partners (for provision of telecoms services)
  • Payment processors and financial institutions
  • Legal and professional advisers
  • IT and cloud service providers (under appropriate data processing agreements)

We do not sell personal information to third parties.

10. Cross-Border Transfers

One Mobile Networks may transfer personal information to recipients in other countries where:

  • The recipient is subject to a law, binding corporate rules or binding agreement that provides an adequate level of protection
  • The data subject consents to the transfer
  • The transfer is necessary for the performance of a contract or for the establishment, exercise or defence of legal claims

Where we use cloud or hosting providers with data centres outside South Africa, we ensure appropriate safeguards are in place in accordance with POPIA Section 72.

11. Security Measures

One Mobile Networks implements appropriate technical and organisational measures to protect personal information against unauthorised access, loss, destruction or alteration, including:

  • Access controls and authentication
  • Encryption of data in transit and at rest where appropriate
  • Secure datacentre infrastructure (ISO-certified Samrand facility)
  • Network security and monitoring
  • Staff training on information security and POPIA
  • Incident response procedures

12. Objection to Processing

Data subjects have the right to object to the processing of their personal information on reasonable grounds relating to their particular situation, in terms of POPIA Section 11(3).

To object to processing, please contact the Information Officer at info@omnetworks.co.za with a clear description of the processing and the grounds for objection. We will consider the objection and respond within a reasonable period.

13. Request Procedure (Form C)

To request access to a record held by One Mobile Networks, the requester must:

  1. Submit a request in the prescribed form (Form C) or in a form that corresponds substantially with Form C
  2. Submit the request to the Information Officer at the contact details in Section 1
  3. Provide sufficient particulars to enable the Information Officer to identify the record
  4. State the form of access required (inspection, copy, etc.)
  5. State that the requester wishes to be informed of the decision and the right to lodge an internal appeal or application to court
  6. Pay the prescribed fee (see Section 14)

Form C (Summary of Required Information)

The request must include: full name and contact details of the requester; capacity in which the request is made (if on behalf of another); sufficient identification of the record; preferred form of access; and payment of the request fee.

Form C is available from the SAHRC or the Department of Justice and Constitutional Development.

We will respond to the request within 30 days. If the request is refused, we will provide reasons and inform the requester of their right to lodge an internal appeal or apply to court.

14. Fees

Fees for access to records are prescribed in the PAIA Regulations. The following fees apply (as at the date of this manual; fees may be updated by regulation):

The Information Officer may require a deposit (not more than one-third of the access fee) before processing the request. A requester may apply for a fee reduction on the grounds that they cannot afford the fee or that the record is in the public interest.
